What we hold, and why

Nana records agreements. To do that we hold some of your information — this explains exactly what, why, who ever sees it, and the control you keep over it.

In plain words

We hold your name, your phone number, and the details of documents you create — because that's what makes a record checkable later. We don't sell it. We only ever share your trade data with a bank or lender if you specifically tell us to, deal by deal, and you can take that permission back.

01 Who we are

Nana is operated by Dalacash Solutions Ltd, a company registered in Kenya. For the purposes of the Data Protection Act, 2019 (Cap. 411C), Dalacash Solutions Ltd is the data controller for the information described here — meaning we decide what is collected and why.

We are registered with the Office of the Data Protection Commissioner (ODPC). Our registration number and data-protection contact are published at the foot of this page. You can reach our data-protection contact at legal@asknana.co.ke.

We are not the Government, KRA, or a bank

Nana is a private documentation service. We are not affiliated with the Government of Kenya, the Kenya Revenue Authority, or any financial institution.

02 What we collect

We collect only what a record needs to be self-contained and checkable later:

  • Your identity — the name you give and your phone number. Your phone number is your account; there is no email or password.
  • Document details — the information you put into an agreement, invoice, receipt, delivery note or similar: the other party's name and number, items or services, amounts, dates and any terms you set.
  • Identity references, where you add them — such as an ID number, only if you choose to include it on a document.
  • Confirmation records — the fact and time that each party confirmed with a one-time code, and the document's SHA-256 fingerprint.
  • Technical basics — the WhatsApp number you message from and basic delivery information, so we can send and confirm documents.
Special care with ID numbers

An ID number is sensitive. We ask for it only where a document genuinely needs it, and you can create most records without one.

03 Why we hold it, and our lawful basis

Under the Data Protection Act we must have a lawful basis for every use of your information DPA s.30. Ours are:

  • To provide the service you asked for — creating, sending, confirming and locking your documents. Basis: performance of a contract with you.
  • To let anyone verify a document you've locked, using its reference or QR code. Basis: performance of a contract, and the legitimate interest of making records checkable.
  • To share your trade data with a bank or lender — only when you specifically ask us to. Basis: your explicit consent DPA s.32.
  • To meet legal obligations — for example responding to a lawful order from a court or regulator. Basis: legal obligation.

04 Who else ever sees it

People you're dealing with

The other party to a document sees the document — that's the point of it. Anyone you or they give the reference or QR code to can verify that the document is genuine and unchanged; verification shows the parties, status, date and fingerprint, not your wider history.

Banks and lenders — only if you say so

We will share your verified trade data with a financial institution only when you give explicit, specific consent for that named institution, at the time it's needed. This consent is separate from accepting these policies, it is logged, and you can withdraw it at any time DPA s.32. We are not a Credit Reference Bureau and do not submit your data to any CRB.

Service providers

We use trusted providers to run Nana — including WhatsApp/Meta to deliver messages, an SMS provider to send one-time codes, and cloud hosting to store records. They act on our instructions under contract.

05 When data leaves Kenya

Some of our providers — including WhatsApp/Meta and our cloud host — process data outside Kenya. Where that happens, we rely on the safeguards the Data Protection Act requires: contractual protections with those providers, your consent, and the transfer being necessary to provide the service DPA ss.48–50. We keep a record of these transfers and the protections attached to them.

06 Your rights

The Data Protection Act gives you clear rights over your information DPA s.26. You can exercise any of these by messaging Nana or emailing legal@asknana.co.ke.

You can complain to the regulator

If you think we've mishandled your data, you can lodge a complaint with the Office of the Data Protection Commissioner at odpc.go.ke.

07 How long we keep it

A locked document is a record — its value is that it lasts. We keep locked documents and their confirmation history for as long as they may be needed as proof, and longer where the law requires. Drafts that are never locked are removed after they expire. When you ask us to delete your account we remove what we can, keeping only what we're legally required to retain, and we tell you what that is.

08 How we protect it

Every locked document is sealed with a SHA-256 fingerprint, so any change is detectable. Data is encrypted in transit, access is limited to what's needed to run the service, and confirmation codes expire and can't be reused. No system is perfect, but a locked record is built to reveal tampering rather than hide it.

If something goes wrong

If a breach happens that puts your data at real risk, we notify the ODPC within 72 hours and tell you where the law requires it.

09 Children

Nana is for adults running their own trade or property dealings. It is not intended for anyone under 18, and we don't knowingly create accounts for children.

10 Changes & contact

If we change this policy we'll update the effective date and, for anything significant, tell you in Nana. For any privacy question, or to exercise a right, contact legal@asknana.co.ke.

01 What Nana is

Nana is a documentation and verification service operated by Dalacash Solutions Ltd. It lets you turn an agreement into a record that both sides confirm, that is then locked so it can't be quietly changed, and that anyone can later verify.

Be clear about what Nana is — and isn't

    Nana does not receive, hold, or move money. Payment happens directly between you and the other party.

    Nana is not an escrow, a lender, an arbitrator, or a party to your deal.

    Nana does not guarantee that the other party will pay, deliver, or perform.

    Nana does give you a confirmed, timestamped, tamper-evident record of what was agreed.

    Nana does let anyone check that record is genuine, at verify.asknana.co.ke.

02 Your account

Your phone number is your account. You must be at least 18 and give accurate details. You're responsible for what happens through your number, so keep access to it secure. If you lose control of your number, tell us so we can help protect your account.

03 Confirming and locking — and what it means in law

When a document needs confirming, each party enters a one-time code sent to their phone. Entering that code is how you accept the document and show you intend to be bound by it. Once the required parties have confirmed, Nana locks the document and seals it with a SHA-256 fingerprint.

Different documents, different confirmation

Not every document is confirmed the same way. An agreement is confirmed by both parties. A receipt is confirmed by the party who received payment. A delivery note is confirmed by the party who received the goods. Each document tells you who needs to confirm it.

Legal effect

Kenyan law recognises records and contracts made electronically KICA s.83J and allows terms to be agreed by reference to another document Law of Contract Act s.3(5). Your one-time-code confirmation is your electronic acceptance of the document. The SHA-256 seal is evidence that the record has not changed since it was locked, and locked records can be produced as electronic evidence Evidence Act s.106B.

What Nana's seal is, and isn't

The seal proves a record hasn't been altered. It is not a licensed "advanced electronic signature," and Nana doesn't claim to be a certification authority. For dealings that by law need an advanced electronic signature or witnessing — such as transfers of land — you'll need more than a Nana record.

04 What you're responsible for

Nana records what you tell it — it does not check whether the underlying deal is true, fair, or legal. So you agree that:

  • The details you enter are accurate and the deal is real.
  • You have the right to include any information you add, including the other party's details.
  • You won't use Nana for anything dishonest or unlawful — see our Acceptable Use Policy.

05 Our responsibility, and its limits

We work hard to keep Nana accurate and available, but we provide it "as is." Because Nana only records what you agree — and never controls the deal, the money, or the other party — Nana is not responsible for the outcome of your dealings: whether you get paid, whether goods arrive, or whether the other party performs.

To the extent the law allows, Dalacash Solutions Ltd's liability arising from your use of Nana is limited, and we're not liable for indirect or consequential loss. Nothing here excludes liability for fraud, or for anything that can't lawfully be excluded.

Your rights as a consumer stand

Nothing in these terms removes or limits any right or remedy you have under the Consumer Protection Act, 2012 or the Constitution that cannot lawfully be excluded CPA s.3(2). If any part of these terms is found unenforceable, the rest still applies.

06 Suspension & closing your account

You can stop using Nana at any time. We may suspend or close an account that breaks these terms or the Acceptable Use Policy, or where we're required to by law. Locked documents already created remain valid records — closing an account doesn't unlock or erase proof that others may rely on.

07 Disputes & governing law

These terms are governed by the laws of Kenya, and the Kenyan courts have jurisdiction. If you have a problem, please contact us first — most things are quickest to resolve directly.

08 Changes

We may update these terms. If we change something significant, we'll tell you in Nana and update the effective date. Continuing to use Nana after that means you accept the updated terms.

01 Scope

This policy applies to everyone who uses Nana. It sits alongside the Terms of Service — breaking it is a breach of those terms.

02 What you must not do

Nana only works if its records are honest. You must not use Nana to:

  • Create a record of a deal that is fake, or enter details you know to be false.
  • Impersonate someone else, or use another person's details without their right to do so.
  • Document or facilitate anything illegal — including fraud, money laundering, terrorism financing, or trade in unlawful goods.
  • Harass, threaten, or deceive another party through Nana.
  • Upload content you don't have the right to use, or that infringes someone else's rights.
  • Attempt to break, probe, or bypass Nana's security, or tamper with a locked record.

03 Honesty about documents

Nana records that both sides confirmed — it does not vouch for whether the underlying deal is true. That makes your honesty the foundation of the whole system. Only create records for real dealings, with details you believe to be correct.

04 Fraud & unlawful activity

Nana holds no money and is not a bank, but we take misuse seriously. We do not knowingly allow Nana to be used to launder money, finance crime, or disguise illegal transactions. Where the law requires it, we will report suspected criminal activity and cooperate with lawful requests from authorities.

05 What happens if you break these rules

Depending on what happened, we may remove a document, suspend or close your account, and — where the law requires — report the matter to the authorities. Records that others have already relied on remain valid; we don't erase proof to cover up misuse.

06 Reporting misuse

If you believe someone is misusing Nana, or that a document about you was created dishonestly, tell us at legal@asknana.co.ke. You can also file a dispute against any document — that right is open to everyone, on every plan.
